Building permits, council and disputes in Clyde North VIC

A new Clyde North home needs a building permit from a registered building surveyor, who carries out the mandatory inspections and issues the occupancy permit at the end. The City of Casey handles planning matters and holds property information such as overlays and termite risk notices. If a builder will not fix a defect, write to them first, then go to the Building and Plumbing Commission's dispute resolution service (formerly DBDRV), and after that to VCAT's Building and Property List.

The building permit and occupancy permit come from a registered building surveyor, not from the council.

Mandatory inspections by the surveyor are for the permit and do not replace an inspection for you.

The City of Casey can supply property information, including overlays, for a specific lot.

Disputes go to the builder in writing, then the BPC dispute resolution service, then VCAT.

Domestic Building Insurance applies to most work over the statutory threshold and covers the builder's death, disappearance or insolvency.

FAQ

Building permits, council and disputes in Clyde North VIC: common questions

Does the council inspect my new house?

Not usually. The private or municipal building surveyor named on your building permit does the mandatory inspections.

What evidence helps in a dispute?

A dated report with photos and clause references, plus your written requests to the builder. If it reaches VCAT you will need an expert witness report.

Is there a time limit on defect claims?

Building actions in Victoria are generally limited to 10 years from the occupancy permit under section 134 of the Building Act 1993. Act early regardless.
